Madonna releases ‘Girl Gone Wild’ single after Joe Francis launches legal action over title change

Joe Francis preached about his “Girls Gone Wild” trademark, and apparently Madonna listened. The Material Girl released her thumping new dance track “Girl Gone Wild” Monday, and Francis is taking credit for its slightly modified name after sending a sharply-worded cease and desist letter before the iconic singer’s Super Bowl performance. The song was listed as “Girls Gone Wild” – plural form – when iTunes started taking pre-orders for the superstar’s upcoming MDNA album several weeks ago….READ MORE

 

 


 

Francis has a federal trademark for the plural form, his lawyer told the Daily News.

“The change is a nice start but not a completed process. I think it’s still too close to be anything other than an infringement, an example of a Material Girl gone wild,” lawyer David R. Houston told the Daily News Monday. He said Francis had not engaged in any negotiations or even communicated with Madonna’s reps over the letter.

 

Madonna’s spokeswoman was not immediately available for comment. “We’ve only seen their reaction. They’ve modified the title of the song, and they think that is enough, but it’s not. We will be letting them know that,” Houston said. He previously said Francis had no choice but to protect his brand.

“This isn’t personally directed at Madonna as a person, this is a business decision,” he told The News. “If Mr. Francis was producing a product called ‘Material Girl,’ and she had a copyright, I doubt she’d appreciate it.”
